Understanding Your Settlement
The moment of leaving a company often raises many questions for the worker. The official document called Termination of Employment Contract (TRCT) is full of confusing items. Our calculator helps you estimate the major blocks of money that make up your severance pay in a dismissal without just cause.
The three pillars of Termination:
- Compensated Notice Period:If the company tells you to leave on the same day, it is required to pay 30 days of salary (plus 3 days for each year worked, on average).
- Proportional Vacation:The time you worked during the year generates vacation fractions. If you were fired halfway through the year, you earn half of a vacation.
- Proportional 13th:Same logic as vacation, you receive the portion of the 13th salary corresponding to the months worked in the year.
Keep an eye out: This tool focuses on the direct labor values paid by the company. You will also have the right to withdraw the total FGTS balance plus the 40% fine, in addition to being able to apply for Unemployment Insurance if you meet the minimum time requirements!
